In the 50 years leading up to 'moore design' Stuart Moore has sold jewelry and brokered diamonds without any legalistic policies. We are advised that, online, these are necessary. Apologies in advance for the tone this kind of document inevitably brings into what is otherwise a joyful event.
Wherever practical, 'moore design' will apply the same fair and common sense policies to our online business as Stuart Moore has always done. However, “just in case”, we lay out in this “legal” section the policies terms and conditions that apply to the moore-design.com website and any associated web sites linked to it.
Please read the contents of this section carefully as, by using the site, you accept the conditions herein. They govern your use of, and any purchase from moore-design.com, and constitute an agreement between you and moore design ltd.
'moore design' reserves the right to change or modify any of these contents at any time and at its sole discretion. Any such change will be effective immediately it is posted on the site.
While we can't imagine any changes of substance in the common-sense way we do business, we recommend you review the contents of this section from time to time to see if any changes have an affect on your decision to purchase from moore-design.com. If you should ever find such a change, we ask you to contact Stuart at stuart@moore-design.com to explain your concerns and we promise to give your input our fullest attention.
moore-design.com shows a mix of products from many designers from around the globe as well as a diamond section. It is exciting for us to combine the very best value in our diamond pricing with the fabulous individual handwork of so many highly individualistic designers, together under our roof. However, this individuality does present a couple of additional complications than more standard “off the shelf” products.
1) We show diamonds by appointment in our offices (or yours) after working with you (email and phone) to determine your needs, budget etc.
2) For jewellery we have three types of service and it is important for consumers to understand the differences to mass marketing websites.
Type 1.
Available from stock of designer. Some of our designers carry some (not all) pieces in their inventory. Since almost all our designers are European, bringing in those pieces especially for you requires insured Fedex shipping and US customs duty charges. Thus, should you wish to return such pieces, there will be a charge totalling $200 in shipping plus 5% of the purchase price for customs. 30-day limit.
Type 2.
Most of the images or photos shown on moore-design.com are not in either our or the designer's inventory. They are purely for presentation of available options by special order and, once ordered, are custom built, by the designer, by hand, to your order. These purchases are not refundable Should you wish to proceed, most designers ship in 3 weeks but the occasional piece can take 4-5 weeks. We always advise you of firm delivery dates before confirming your purchase and finalizing payment.
Type 3.
Sale pieces. In the SALE section you will find a selection of pieces from the now-closed stuart moore galleries at various discounts. They are available on an “As Is” basis and non-refundable.
Although we make every effort to make sure no mistakes happen on our site, some will inevitably occur and we reserve the right to correct such errors when they do occur.
For example, should we show a product at a lower price than its actual price we will contact you so that you can decide whether to continue with the purchase at the proper price or cancel. If we show at a higher price than it's actual, we will refund the difference.
We will do our best to notify you of either of these price errors before we ship. If the price you paid was too high we presume you'll be happy to get a rebate. If the listed price was too low and the order has been shipped, you agree to either return the product or pay the difference between the actual and charged prices. If you cancel you will receive a full refund and our apologies.
Although we don't change prices very often, platinum, gold and diamonds do fluctuate so our prices are subject to change without notice.
We are not a high margin retailer, pricing high to enable us to offer 'discounts'.
As we sell only GIA certified diamonds at really great prices and all our designer pieces at their creator's worldwide selling price, we already offer excellent value so do not negotiate our prices.
However, should you find any of our designers' pieces advertised elsewhere in the USA for less than the exact same piece at 'moore design', please notify us. In normal circumstances it is our policy never to be undersold so we will either refund the difference or accept the piece back for refund.

Every diamond over .75 carat sold at 'moore design' comes with a grading certificate from the Gemological Institute of America (GIA), in our opinion, although not useful for pricing, the GIA is still the world's most utilised gem lab.
These certificates are costly. When you buy a loose diamond from us we send it to you with this certificate so, if you should decide to return this stone for a refund or exchange, you must return the certificate as well or we must charge you a replacement fee of $300.
moore-design.com will comply with all federal and state law regarding charging sales tax on purchases made from our site.Thus, in completing a purchase from moore-design.com , you will normally have to pay Sales Tax at the rate in your recipient state.
If you believe you are exempt please contact Stuart Moore at Stuart@moore-design.com and give the reason. If Stuart , on behalf of moore-design.com agrees to deliver the purchase without Sales Tax you will be required to sign a document which states you hold moore-design.comharmless from any claims by Sales Tax authorities and agree to settle the matter directly with those authorities. Should said authorities deem moore-design.com is responsible for collection, you agree to pay the assessed amount of tax and any penalties the authorities may assess within 30 days of our notification to you of the assessment.
At moore-design.com we make every attempt to ensure that our product listings are as current and complete as possible. However, due to differences in photographers, computer screens et al, some products may, onscreen, differ in colouring or size than they really are so please note the measurements given with each piece or, if not noted, please contact us so we can provide them.
The measurements of jewelery pieces or stone weights shown on the site may vary marginally from the actual.
Stone weights follow one of two rules:
Since all our individual stones come with a GIA certificate we show the weight shown on that document.
For collections of small stones we show 'total weight' within the FTC regulation 0.05carat tolerance.
On such multi-small-stone pieces the colour and clarity shown is the minimum, thus every stone in that piece is that quality or higher.
Here's one of those tricky policy issues that we were advised to cover with legal terminology. Apparently it is often the case that online buyers pretend they want to buy several pieces while their real intent is to wear one piece for a special occasion, keep none or just one and return the rest. In a bricks & mortar situation this is easy to figure out so can be prevented (it costs the seller a lot of money) but is more difficult to monitor online.
Of course we are delighted if you choose to buy several pieces but we do not allow customers to “comparison shop” as described above except, in rare circumstances, by common-sense arrangement with us in advance. Without such special arrangements moore-design.com, at it sole discretion, retains the right to refuse returns.
Moore-design.com purchases diamonds only from cutters and dealers we have worked with for many years, every one of whom has long ago joined us in abhoring the human cost of what are known as conflict (or blood) diamonds.
There is a now a control and regulatory organization in place called the Kimberley Process which all our cutters and dealers are actively involved in and, to the highest degree possible to anyone in our industry, this ensures every stone we handle is free of such contamination.
We have on file certificates of support and adherence to the Kimberley Process from every diamond supplier we deal with.
Our privacy policy is pretty clear. We share information you give us with no one outside moore-design.com without your express written authority. No ifs ands or buts.
Should we ever sell the company, the data we have gathered (including our business with you) would be transferred only to the new owner.
Our website's content is protected. We show designs from many designers, use graphics, videos, photographs, text, files and custom built software. All this comprises a “package” in our unusual minimalist style. This package is the proprietary property of moore-design.com its suppliers or agents and is protected by copyright, patent and trademark law as well as other rights covering unfair competition and intellectual property.
Moore-design.com grants you a limited, non-sub-licensable license to access and make personal use of this site but (other than caching or copying certain pages for non-commercial use) not to download or modify any portion of it except with our express written permission.
This licence is limited and forbids your taking any of these actions without our express, written permission:
1) Any use of the site which interferes with its normal operation.
2) Any commercial or resale use of this site or its contents.
3) Reproduction, duplication, copying, selling, reselling, visiting or in any other way exploiting our site for any commercial purpose.
4) Downloading or copying of account information for the benefit of another merchant.
5) Framing, or using other framing techniques to enclose text, images, logos, trademarks or any other proprietary information.
6) The collection or use of any product listings, descriptions or prices.
7) Any use of meta-tags or 'hidden text' technology using the name moore-design.com

9) Derivative use of this site or its contents.
Any such unauthorized acts will terminate and revoke the permission or license granted by moore-design.com. Such actions may also be in breach of various copyright, trademark and applicable communications regulations and statutes. Finally, unless specifically stated herein, nothing in this section shall be construed as granting license to any intellectual property rights whether by implication or otherwise.
Moore-design.com grants you a limited, revocable and non-exclusive right to create a hyperlink to the moore design homepage as long as this link does not portray moore-design.com its designers, products or services in a negative, misleading or otherwise offensive manner.
Our policy for those who, in our opinion, infringe on other people's intellectual rights, is to terminate and prevent further access to our site, in accordance with the Digital Millennium Copyright Act (DMCA) and other applicable law.
Moore design may provide links to Web pages and content of third parties as a service to those interested in this information. Moore design does not monitor or have any control over information given in those links so cannot endorse or guarantee their accuracy.
